State of Florida vs. Patient David Oliver

Patient David Oliver was arrested for possession of cannabis in St. Lucie county after getting his Florida Medical Certification and State Issued Identification Card. He is now facing criminal charges and fighting for his right to use cannabis as a qualified patient. Amendment2 specifically states that a qualified patient is not subject to criminal or civil liability or sanctions under Florida law.

The arrest of this patient violates his rights under the Amendment. The patient, David Oliver, has a right to the acquisition, possession, use, delivery, transfer, or administration or an amount of marijuana not in conflict with the department rules. Any limitations by the department, other than the amount of the marijuana violate the patients’ rights.

Mr. Oliver stands up for all the patients in defending his right to possess and use cannabis flower. The Legal Director of NORML of Florida, National NORML Legal Committee Member, Florida Cannabis Coalition Member, and Chairman of Regulate Florida, Michael C.
